For homes on large lots, can LL 3.3 be awarded if the LEED home is built on the site of a previous home, even if most of the rest of the site is undisturbed? Or, does 75% of the total buildable lot need to have been previously developed in order to earn this credit? For example, consider a project in which the total lot is 1 acres, the previous existing home and its development (e.g., driveway, landscaping) took up 1/10th of an acre, and the new home and its development will be built on the same 1/10th of an acre.

Ruling

No - LL 3.3 should only be awarded if 75% of the total buildable land was previously developed, even if the new home is built on the footprint of an existing structure. To be clear, previous development includes built structures, paved areas, and also designed landscapes, although forested areas and farmland are not included. In the example provided, only 10% of the buildable land is previously developed, so the credit should not be awarded.
