We have registered an Office building in the Washington DC Metro area to be certified under LEED-EB O&M Rating System, and would like confirmation that the Office building pursuing certification is considered separate from an adjacent Hotel unit by USGBC and GBCI, and can be certified independently as a LEED-EB Office building.While the entire Complex has been legally deemed a "Condominium", the site has two distinct and independent units - an Office Building and a Hotel Building. Each entity is under separate management and each has an entirely different function.Above grade, (above parking level) the two buildings are completely structurally separate. Three documents, The Declaration for Condominium, The Bylaws for the Condominium, and Condominium Plat As-Built Plans further define the definitive separation between the Office Building and Hotel Building. The Condominium Plat show exact property lines and separation of building structures in plan, elevation and section. These can all be provided to the USBGC and GBCI if necessary.The property company that operates and manages the Office building, on behalf of their ownership, has documentation stating that the buildings share only a below-grade parking garage structure upon which both buildings are built and a portion of the utilities which are metered to the Hotel entity. The Office entity and the Hotel entity are separately managed, and the complex\'s bylaws state: "Regardless of the location of the [Mechanical] Equipment, the Equipment shall be separately metered and operated independently of any equipment serving the other Unit." The following are "shared" between the Office and Hotel:1. Electricity: a portion of one of the Office building\'s chillers is sub-metered for service provided to the Hotel. The sub-meter is read and billed to the Hotel on a monthly basis. The electric provided to the Hotel runs their chiller, which provides air conditioning to their 1st floor lobby only.2. Potable Water Supply - Municipal System: a portion of the Hotel\'s water service is sub-metered for service provided to the Office building. The sub-meter is read and billed to the Office building on a monthly basis. The water is used by the Office building for its domestic water supply and for make-up water to the cooling tower and the air conditioning equipment within the building.3. The underground parking garage has four floors which are strictly divided, 50/50 each, for the Hotel and the Office. Each separate management company has complete control over their portion of the parking spaces, and all associated revenues, costs and expenses.Other than the shared common area elements associated with the parking garage structure, and the separately sub-metered utilities, all listed above, the Office building Unit and the Hotel Unit are stand-alone properties which operate entirely independent of each other.

Ruling

It is permissible to set the LEED project boundary to exclude portions of the site as is reasonable in complicated scenarios, such as in your case, providing that the same boundary and scope are used for all credits. Applicable internationally.
