Due to the nature of the business, the remoteness of this site from the town center, and the fact that the site is located adjacent to a river, all wastewater generated by this project will be treated on-site. The septic treatment system to be used is a solar aquatic treatment system, and the cleaned effluent will be discharged into the river. It is reported by the septic treatment plant engineers that the treated effluent is drinkable by humans. At issue is the fact that the treatment plant building is located within 100 feet of a wetland. The building is located within 100 feet of the wetland because it needs to be located close to the wetland for effluent discharge. All other requirements of this credit are met. Please confirm that this approach is acceptable.

Ruling

The project does not meet the requirements of this credit, and would therefore not be awarded a point. The credit requirements state that no buildings shall be constructed within 100 feet of any water, including wetlands. Wastewater treatment systems in particular, should not be permitted to encroach upon this setback requirement because of concerns about flooding, sewage overflow and leakage. It is important to keep in mind that not all LEED credits are applicable to all projects. Applicable Internationally.
