We are an architectural firm buying an existing building in a downtown urban environment. As such, there is on-street parking, none of which is dedicated to the actual employees of our building. The on-street parking is on a first-come first serve basis. We also intend to occupy approximately 73% of the building and lease out approximately 27% of the building. We intend to seek certification for the entire building under the LEED CI v2.0 checklist. Based on the fact that our architectural practice will occupy only 73% of the building, can we attempt SSc3.3 under Case A, whereby "no parking will be provided or subsidized for tenant occupants". Obviously, with city-owned on-street parking adjacent to the building, we cannot designate car-pool or van-pool parking spaces. Also, would the purchase of a "company" hybrid vehicle for staff use in running daily errands during business hours and having this vehicle in a "subsidized" space preclude the taking of credit SSc3.3? Could we still take SSc3.3 and also use the hybrid vehicle in helping meet the requirement under LEED CI v2.0 credit SSc1.0 Option L whereby we can use SSc4.3 under LEED NC v2.2?

Ruling

The project team is asking three separate questions regarding SSc3.3 in the above narrative. The first question asks if the project can pursue SSc3.3 using a Case A compliance path. The narrative indicates that the project will occupy 73% of the overall building area and is not providing or subsidizing any new parking for the tenants/occupants. As noted, the project can pursue SSc3.3 using the Case A compliance path. The second question is asking whether the SSc3.3 Case A compliance path is still valid if the project provides a company owned, low-emitting, fuel-efficient vehicle for use by staff and subsidizes one parking stall in adjacent, existing parking facilities for that vehicle. If the project is only subsidizing one parking stall for the dedicated use of this shared vehicle, Case A compliance is still applicable. The third question applies to SSc1 and does not include enough information to provide a ruling on. This question should be addressed as a separate CIR under the appropriate credit.
