The site in question is a 42.3 acre site that was a previous homestead with adjacent farm ground. This 42.3 acres is a portion of a larger overall piece of ground that has been recently designated and rezoned as an Industrial Park by local city officials. City officials have also designed the new infrastructure for the entire Industrial Park and will put it in place as new facilities come on line.The site does not meet any of the "Do not develop" criteria as listed in the Reference Guide.This site will accommodate a new building that is located within 1/8 of a mile of an existing facility of the owning company - facilitating short travel distances for transporting goods and materials from building to building.Please rule if this site would be consistent with the intent of this credit.
The CIR is inquiring if a site that was previously designated as a homestead with adjacent farm ground can comply with the requirements of this credit. The inquiry also indicates that the site does not meet any of the prohibited criteria as indicated in the Reference Guide. While it is not clear from the submitted inquiry if the farm land is part of the subject property or adjacent to the site, the project site can comply with the intent and requirements of this credit if the land is not designated as prime farmland by the United States Department of Agriculture in the United States Code of Federal Regulations, Title 7, Volume 6, Parts 400 to 699, Section 657.5 (citation 7CFR657.5) as indicated in the NCv2.2 Reference Guide. Note that the land also needs to meet all the requirements outlined for compliance with this credit. Applicable Internationally.
