In yet another variation on the theme of what qualifies as "Indepedent" for tasks 1-3 of EAc3, we have an MEP firm writing a performance spec for the HVAC system of our project. The performance spec writer is a consultant to the owner. After the performance spec is complete, the MEP systems will be turned over to a design-build firm who is a sub of the General Contractor, and the performance spec writer will have nothing further to do with the design. The design-build sub will design the MEP systems to the spec created by the performance spec writer. Our question is whether the performance spec writer may also serve as the commissioning agent for EAc3\'s tasks 1-3.

Yes, the entity hired to develop the performance specifications can also be hired to perform the commissioning IF there is a clear distinction between the performance spec writer (PSW) and the design team producing the Design Development Documents and final Construction Documents. For example, if the PSW is contracted to develop the narrative documentation that defines the Owner\'s Project Requirements, then the PSW is qualified to review the Design Development and Construction Documents. But the PSW is not qualified to provide commissioning reviews if the PSW\'s responsibilities include the development of detailed design concepts. Applicable internationally.
