Our project has saved over 94% of the structure and shell and 65% of the non-shell items. Using the MRc1.2 CIR ruling dated 4-10-03 (equivalence granted for reuse of 98% shell/structure plus 20% non-shell/structure), will we be able to earn MRc1.2 (with non-shell items making up the difference) and subsequently have enough "left over" to also earn MRc1.3? If this is not permissible, can MRc1.3 be earned without first earning MRc1.1 and MRc1.2?

Ruling

The following response addresses the situation outlined in the inquiry and clarifies the MRc1.2 CIR ruling dated 4-10-03. The MR TAG has ruled that 95% of structure and shell have to be reused in order for the 4-10-03 ruling to be applicable. As such, if a project retains 95% shell/structure and at least 5% non-shell, it may earn 2 points (MRc1.1 and MRc1.2). For simplicity and clarity, the ratio between structure/shell and non-shell items will be considered 1:1. For a project to earn all three MRc1 points using this methodology, the project must minimally retain 95% structure and shell AND 55% of non-shell (of which 5% would contribute to MRc1.2, leaving 50% for MRc1.3). MRc1.1 and MRc1.2 can not be decoupled from MRc1.3 for LEED-NC v2.0 and v2.1. Applicable internationally.
