Sprint building 14 is part of a 20 building, 208 acre corporate campus that was constructed on under-utilized farmland. Sections of the farmland included drainage swales between the fields that were designated as wetlands (manmade). As part of the initial site development phase of the campus, the Army Corps of Engineers issued a permit(nationwide permit 26) to move the 5.4 acres of existing manmade wetlands and replace them with 7.4 acres of new wetlands. The new wetlands are located in and around the lakes at the southeast corner of the site, which are more than 100\'\' from any buildings on the site. Building 14 was developed on a portion of the site that is further than 100\'\' from the current wetlands. A corner of the loading dock of the building falls within the 100\'\' limit of the previous manmade wetland location. We feel the intent of the credit has been met by relacing and expanding manmade wetlands on the site, providing a better wetland location and protecting these wetlands from the adverse effects of building near them.

Ruling

The intent of the credit is to avoid development of inappropriate sites and reduce the environmental impact from the location of a building on a site, and the requirement in question requires no development on portions of sites that fall within 100 feet of any wetland as defined by 40 CFR, Parts 230-233 or Part 22. "Moving" or replacing impacted wetlands is not an acceptable path for compliance for SSc1 because an established habitat is destroyed in the process. If the original wetland is destroyed OR if any portion of the building is within 100 feet of any wetland the project does not qualify for this point.
