For EQ 4.1 part (b) of the Mid-rise Pilot Guidelines, do operable windows count as an outdoor air intake? What about trickle ventilators integrated into windows.

Ruling

**Updated 7/1/2015 to remove reference to an invalid CIR.
Operable windows are not considered an acceptable make-up air source for the purposes of part (d), but they are subject to the separation distance requirements in EQ 4.1, part (b).However, EQ 4.1 part (b) in the Mid-rise Pilot Guidelines may be met by satisfying Section 6.8 of ASHRAE 62.2 for the residential portions of the building. According to this section, "Air inlets that are part of the ventilation design shall be located a minimum of 10 ft from known sources of contamination, such as a stack, vent, exhaust hood, or vehicle exhaust. The intake shall be placed so that entering air is not obstructed by snow, plantings, or other material. Forced air inlets shall be provided with rodent / insect screens (mesh not larger than 1/2 in. [13 mm])." This section also includes the following exemption: "No minimum separation distance shall be required between windows and local exhaust outlets in kitchens and bathrooms." This exemption extends to windows with integrated trickle-ventilators.
