You need to accept the Design Final Review (or appeal) before you can submit the Construction Phase credits. Depending on the status of the design credit review, it may be possible to push the project out of review, skip the Final Design Review and submit the design credits for their second review in the Construction Preliminary Review. You would need to contact USGBC to determine if this is possible for your project.
Otherwise, you can upload everything for the construction credits so they can be submitted promptly when the Design Final Review Comments are received (and accepted). If necessary, design credits can still be appealed at the end of the Construction Review Phase.
