This may be a silly question, but I ask in order for some clarification. I have a particular question using the 40/60 rule. The project is not currently registered on LEED Online, but we were originally going to use the LEED v4 BD+C New Construction and Major Renovation rating system. It is a major renovation project that is for an existing building, we have scope of work for the MEP systems, as well as interior and exterior architectural work scope. However, there are concerns after going through a preliminary review of possible credits that we will not have enough points to achieve LEED Silver. This project is in New York City and it is owned by the city, we have a local law that stipulates certain city buildings must achieve LEED Silver or higher. If we were to proceed with the 40/60 method, there is a possibility that more than 60% of the project square footage would apply to LEED v4 ID+C: Commercial Interiors. However since the project itself is major renovation and not a tenant fitout, could we be allowed to change the rating system even if that would ignore the exterior and possibly some of the interior architectural components of the original renovation work scope?

The scenario you are describing sounds like a major renovation. Check the guidance again and look for the portion of the document that describes the entity performing the project to also be owners of the building, which might push you towards NC.
There is a specific line in the guidance that describes where although the major renovation project and an interiors project both apply to the whole area and would be > 60%, since the building is owned (and occupied?) by the same entity most likely NC is the recommended path.
Hopefully you can add additional sustainable features to increase the projected score to Silver.
You could also try to reach the GBCI directly to clarify the situation, you may want to get an official ruling if the manager of the project are serious about possibly using ID+C.
