EBOM allows up to 10% of spaces to be excluded from certain credit calculations. Can we exclude any spaces from the calculations for IEQp1? Our client building has several small tenant spaces, which have their own HVAC systems and ventilation. In at least one case, the retail space has inadequate ventilation, and we have no ability to change this situation. I'd hate to have to miss out on LEED Certification because of one small tenant. Can we exclude them from the calculation?

Can they meet the 10 cfm/person alternative?
Does the building provide the tenant with the means to have proper ventilation but the tenant just elects to have an inferior system?

Let's assume for the sake of argument they can't meet the 10CFM without spending money. And lets assume the tenant doesn't want to spend any money. Can we exclude them?

Unless you are not including those spaces in your "LEED Boundary" then I'd assume those spaces need to comply. Without spending money is not an excuse. You're not just going to get handed a LEED plaque without work in most cases.
