Lease Agreement an option to comply with the credit requirements

Hi, We are currently documenting the requirements for PIf4 and our option in order to comply is to provide a Tenant/Lease Agreement for certain credits. The LEED requirement says, "provide the legally binding document associated with the project, signed by both the developer and the tenant, explicitly stating the performance requirements for the tenant work." Since at this time, it is still unknown to the owner who will be occupying the tenant spaces and no one has to sign yet for the tenant. What other options can we do to meet the requirement? Please advise. Thanks a lot!

Your project case sounds more like a LEED-NC project (owner building with space for future tenants), rather than a LEED-CI project (interior tenant finish-out). Under the LEED-CS and LEED-NC rating systems, it is recommended to create a Tenant Design & Construction Guidelines document. This document can be signed by the Owner, and clarifies what is required of any future tenants in order to comply with the building's LEED certification. Additionally, as you've mentioned, you could provide a lease draft which lays out the wording of the performance requirements, accompanied by a signed Letter of Commitment from the Owner, promising to hold all future tenants accountable to the language in the sample lease draft.
