Our project was recently denied both of these credits on not meeting the 5% requirement. The project has a total of 62 parking spaces out of these spaces 3 spots were alloted to LE/FE vehicles and 3 spots were alloted to Carpools and Vanpools. When we originally ran the calculations 5% of 62 = 3.2. We rounded to the closest full number and provided 3 spots for both credits. On the form 3 of 62 = 4.9%. Both of these credits however were denied on not meeting the 5% requirement. Has anyone else experienced something similar? When we originally ran the calculations for both of these credits I remembered reading the LEED book very carefully and checking any possible addenda or CIR's for this credit and could not find anything that addressed this matter.

Unfortunately, the credit requires a minimum of 5% of spaces reserved so you have not fulfilled the intent of the credit - you must always round up. There is a tread about this dating back to April of 2011 and I also believe that it is addressed in the Interpretation database.

Ellen, thanks so much for the quick response.
Now that the credits have been denied as part of the final review, would there be a way for the project to earn this point back? Would we have to provide 1 additional spot (one for LE/FE and one for HOV) and then appeal the credit?

Yes, you would need to provide a total of 4 spaces for LEFEVs and 4 spaces for carpooling vehicles in order to meet the intent of both credits. If you are willing to do this, you will have to appeal both unfortunately ($500/each).
