Our project is currently at the Construction Final Review Stage and we would like to submit an appeal on 2 of our Design credits. How is this done? I tried during the Construction Preliminary Review but apparently the appeals were not submitted correctly. When I go to the "Timeline and Reviews" pages the Design Appeal Review category is blank,

Project teams can only appeal credits (or prerequisites) after the final design review or after the final construction review. After your design review was complete there was the option in LEED Online to appeal credits or to move into the construction review. Your project team must have selected to move into the construction review. Note that there is no difference if you appeal the design credits after the design review or after the construction review.
Once your final construction review is complete you will see the option in LEED Online to appeal any credit. Select this option to appeal the credits.

There is an appeal fee for each credit: $500. There is a new appeal category for "complex" credits: $800. Complex Credits are, for the most part, EAp1, EAp2, EAc1, and EQp1.
The documentation for EAp2 and EAc1 are identical. The GBCI/USGBC does not explain whether a challenge to EAc1, which automatically pends or challenges EAp2, requires payment of two "complex" appeal fees or just one. My assumption is just one appeal fee is paid for these two depending on whether EAc1 is submitted or not.

Usually project teams' review comments will state that the project team does not need to appeal both EAp2 and EAc1 and that if a project team wishes to appeal EAp2, the status of EAc1 will be updated based on the results of that appeal. Project teams should refer to their review comments for confirmation.
Regarding complex credit appeals, there is information on our website available through this link http://www.gbci.org/main-nav/building-certification/fees/info.aspx#energ.... Complex credit appeals became effective on September 16th, 2011. Note that the fees for complex credit appeals are based on the date of an appeal submission, not a project's registration date.

Jeremy, the clarification you provided is missing from the fees webpage.
I have yet to see EAp2 denied with EAc1 approved: over 100 LEED projects. I suppose it could happen if other than an energy analysis is used as the documentation path. Still, EAp2 is essentially a 0 point performance for EAc1.

To add to your first reply on this thread. Can the same apply to LEED ND?
That means a failed prerequisite can be appealed after the Stage 1 (Preliminary Design) Review, after Stage 2 (Final Design) Review, and/or after Stage 3 (Construction Review). Am I reading you correctly?
