I am working on a C&S office building, and I'm reading differing viewpoints on this credit and IEQc8.2. Must these credits be included in the Tenant Lease agreement? Can I submit these credits without including them in the lease? Our owner is very afraid of scaring off potential tenants, and will not include this in the lease agreement if it restricts how the tenants will be laying out their floorplans. Is there any way I can submit for this credit without including it in the tenant lease?

The one way to determine whether a specific credit requirement must be part of the tenant lease agreement is to look in Appendix 4 in the Reference Guide. EQc8.2 is not included in Appendix 4, therefore, it does not need to be included in the tenant lease agreement. It should be part of your tenant fit out guidelines. The only requirement in regards to CS projects is to provide a proposed tenant fit out when documenting the credit.
