Satisfaction of the authority

Dear Florian, did you get any response to your question? I have a similar problem and I wanted to ask if you were able to receive points for this credit.

I have a similar question: our project is a new building on a state university campus. The university suspected that there was asbestos in a deactivated underground steam pipe that crosses the site. During demo and site prep, the area was excavated and the pipe tested by a licensed lab and a report provided by a HazMat consultant. It did indeed contain asbestos, and is currently being abated. What kind of documents qualify for "Documentation from authority having jurisdiction declaring existence of specific contamination and confirming that remediation has been or will be completed to its satisfaction."? There is no precedent for a government agency testing the site or observing the abatement process. Is a particular license required  conferring such authority to the HazMat consultant? In v2009, we used consultant reports. I notice that one company had 2 certifications: DOSH (Dept of Occupational Health & Safety), Certified Asbestos Consultant and CDPH (CA Dept of Public Health), Certified Building Inspector/Assessor. Are these the certifications required?

Florian, Who receives the confirmation of the abatement? That will be the authority. Typically we document compliance by a letter from the company that does the abatement certifying that the site is acceptable for occupancy, listing the standards followed for assessment and abatement (ASTM standards or ISO standards) and any testing done before, during and post abatement. I would recommend you file a Credit Interpretation Request to get an official ruling. You should also point this out to USGBC as this issue should be addressed in the ACP for Europe document.  Susan, Asbestos abatement has been removed as an alternative compliance path for this credit. Although since this is an underground condition, it might be acceptable. Typically we document compliance by a letter from the company that does the abatement certifying that the site is acceptable for occupancy, licenses granted by the state or EPA to the contractor (depending on who manages the EPA program in the jurisdiction, but typically states), listing the standards followed for assessment and abatement (ASTM standards or ISO standards) and any testing done before, during and post abatement.    Hope this helps.
