We are doing a zero-lot line project in NYC on a very narrow site. The program is located on 2 floors each with a large performance space located in toward the rear of the lot.
This is a 2-part question:
1. Do performance spaces (theatre/ dance studio) or lounges (where people wait for performances) fall under Regularly Occupied Space? Should they be included in the View calculation/ building section if there are no desks? There will be 42" view access and someone will spend 1 hour/ person/ day - with practice/ rehearsals.
2. The basement floor of this building has windows, but the view is partially obstructed by a retaining wall and existing fire stair that is roughly 6'-0" from the window. Views are accessible from 42" to 90" AFF, but the sight line is slim.

Theatres can be excluded due to the requirements of the space needing controlled lighting. You will have to explain the reason for them being excluded. If it soley just a dance studio, then you would need to include it. There are many studios with views. If the space is considered a lounge then yes, but if its considered a lobby, then no.
The basement would meet the requirement. There is no requirement for how far an object has to be away from the glazing on the exterior.
