I don't see where the preventive maintenance program is required for LEED submittals, is this just best management practices or actually required?

This is referenced most directly in the EBOMv2009 submittal template and should be considered a requirement:
"Describe the plumbing fixture and fitting inspection, testing or preventive maintenance program in place for the
project building. Describe how the inspection, testing or program ensures the following:
1) Flush and/or flow valves do not leak and
2) Auto-flush and/or flow sensors are calibrated so fixtures flush and/or flow properly and at the proper time
but not too often or for too long a time (i.e., generally only one flush per fixture use)"
