I am pursuing the ALL-Gender Restrooms Innovation. Under Requirments for ID+C it reads Restrooms must be included within the project scope of work in order to pursue this pilot credit. The Tenant has taken a full floor in a building. There is one bank of restrooms( male and female) just outside the tenant space on the floor. The tenant is adding two all-gender restrooms within the scope of work. The new single-stall facilities will meet ADA requirements for restroom layout and accessibility. My take is that the we will comply with the requirements dispite the fact that the male and female restrooms are outside of the project scope of work. Any thoughts on this?

We asked pretty much this exact question just recently and got a response from LEED Coach. Here it is for reference:
"The Pilot Credit: All Gender Bathrooms, Option 1 defines the requirements as, "build only all-gender facilities". In the case of a tenant fit-out, where all bathrooms within the scope of construction are considered all-gender single-user restrooms, would this not fulfill the criteria of Option 1? Does the presence of gendered base-building bathrooms (that are accessible to tenant occupants) automatically disqualify a tenant fitout from using Option 1? If a project team has ensured that all newly built restrooms within the scope of the fitout are all-gender accessible, this would seemingly fulfill the criteria put forth by the pilot credit.
Please clarify whether Option 1 is viable for a tenant fitout with access to a gendered base building restroom, or if this case only applies to Option 2, requiring supplementary all-gender facilities per each bank of gendered restrooms."
Response:
"An ID+C project that includes only all-gender restrooms within the project scope could achieve this credit if all requirements are met. Note that in addition to the bullets under Option 1, the project scope would need to include a sufficient quantity of fixtures to meet the requirements under "Refer to Table 403.1: Minimum Number of Required Plumbing Fixtures in the 2021 International Plumbing Code (IPC) Requirements for required fixtures in each facility."
As stated in the credit language, "For ID+C projects, restrooms must be included within the project scope of work in order to pursue this pilot credit." A combination of base building restrooms and ID+C space restrooms can be used to demonstrate compliance."
