CS-2009 EAp2:Minimum Energy Performance

Open Sales Area - qualifications

We are on our final review for EAp2 and have changed site area from plaza designation to an "outside sales area." The owner proposes to have concerts, arts festivals,etc. There will be vendors selling art, food and other items. This will not be every day of course, and at this point we are not sure how many festivals, concerts and other events that will take place. We do expect many or perhaps most weekends. Can anyone provide information about how this will accepted by LEED reviewers?

As a reviewer I would be highly suspicious of such a change, especially in the middle of the review. Sounds like at best the festivals are not happening for the vast majority of the time and the "sales" aspect is not even a permanent fixture. So to me that is not the primary use and should not be used. On the face of it this appears to be an attempt to increase the baseline to show more savings. I would suggest that you stick with the original, more conservative choice unless you can provide a much better explanation for the change than provided above.

Thanks for your reply. Perhaps I should have been more explicit. The three CS multi-story buildings are a campus project in Fort Worth, TX - warm nearly all year. Project is mixed use-with restaurants, bars and outdoor seating for each. There is a permanent stage and dressing rooms for performances. Also a 6,400 square foot shade structure for restaurants table seating, festivals and performances. Owner has booked significant events - all which help the retail/hospitality tenants prosper. Does this sound more like it in your view?

Still does not sound like outdoor sales to me. The example for this is a vehicle sales lot. At best you may have a case for part of it being outdoor sales. You may need to break this up rather than assume it is just one application. If you use one application I would recommend that you use the lowest to avoid any questions or issues. If you make this change be sure to include a thorough justification and explanation.
