The MERV-13 filters would need to be in place at the beginning of the EBOM performance period Susan. The rating system does not currently allow for a phase-out plan approach to this credit. Your situation is actually fairly common in my experience - many buildings either are not capable of using MERV-13 or simply feel it is excessive in terms of the additional energy costs relative to IAQ benefits. Makes sense for some buildings, less for others.

Since IEQc1.4 requires you to provide MERV 13 or better on all outdoor air intakes, you won't get it. Try ACP (Alternate Compliance Path).
