Our project received the following review comment:
"If any building spaces do not have automatic lighting control, provide information on the use and square footage of these spaces.
Up to 10% of the total floor area in the building may be exempted if the building management does not have control over the lighting controls in the exempted area."
We do have areas with uncontrolled lighting, but we do not know if we meet the exemption requirements. What exactly does "building management does not have control over" mean?

Hi Katherine,
To me, that comment sounds like it's referring to the 10% exemption rule for multitenant buildings (see pg. xxiii of the Reference Guide). That rule allows project teams to exempt areas of the building (up to 10% of the total floor area of the building) with subtenants that have their own operations and don't agree to participate in the EBOM process. If the spaces don't have controls due to this type of management distinction, you can use the 10% rule to set a boundary. If the areas are in your managerial control and are located throughout the building, such as all the elevator lobbies or something like that, unfortunately you wouldn't meet the credit requirements without some type of lighting control.

It's not applicable to IEQp2, and not applicable to EAp2 if the exempted area is an ENERGY STAR-ratable space type (this would affect your score).
