The way I read this is that LEED only requires a contract to be in place for the 10 Month Review. The contract must include in its scope:
1) One 10 Month Review Plan which will incorporate a plan for resolution of outstanding commissioning-related issues 10 months after substantial completion.
2) One 10 months after substantial completion Site Visit.
3) One 10 Month Review Document on the findings of the review, corrections, recommendations of the plan and site visit.
This is confirmed by the LEEDonline submittal form which reads:
"The CxA was / will be involved in reviewing the operation of the tenant space with operations and maintenance (O&M) staff and occupants within 8 to 10 months after substantial completion. A plan for resolving outstanding
commissioning-related issues was / will be included."
