Hi Leslie,
The requirement of MERV-13 is for ventilation system that supplies outdoor air to occupied spaces. If the recirculated air delivered by FPTU does not supply outdoor air to occupied space, then it does not need to be filtered by a MERV-13.

Is there a specific CIR that addresses this? I am working on a project utilizing a VRF system with a dedicated outdoor air unit where this scenario would apply.

I agree with Afogreen Build.
per the credit language: "Each ventilation system that supplies outdoor air to occupied spaces must have..."
recirculated air through a fan powered terminal unit is not a unit that supplies outdoor air, hence it is exluded from this filter requirement. a CIR should not be required.

david has this right - the requirement is clear in the credit language. MERV 13 is required where the outside air enters the system and nowhere else.
