In a contractual situation where the contractor, owner and architect are bound in a single contract, who is able to hire the CxA for enhanced commissioning? In theory, all parties share the same goals and motivations.

I have been involved in several true Integrated Forms of Agreements over the years, including one that had 6 signators! That was a fun one to negotiate...NOT! But frankly, it was one of the best projects I have been involved with. Owner, General Contractor, Architect, Mechanical Contractor, Electrical Contractor, and MEP Engineers (my old firm). Anyway, neither here or there, but I am old and can tell stories when I want to!
The form of contract does not change anything under LEED, but with the current LI allowing the contractor to hold a contract for the CxA, it really can be any of them. Personally, it is always my preference to work for the Owner. Clean, neat, direct, clear, and of value.
