We have an existing facility (bus maintenance garage) which is attempting to be Certified. The maintenance bay which will be heated and ventilated during the winter and just ventilated in the summer will be served by make up air units with energy recovery, as part ot the new work. The space temperature has been deemed to be set at 65 degrees F for the winter operation.
ASHRAE 90.1-2007 Appendix G paragragh G3.1.2.10.a states that the baseline case can be exempt from using energy recovery provided that the space is not cooled and that the space is heated to less than 60 degrees F. Since we are heating the space to 65 degrees it would appear that this exemption cannot be apllied?
Does this requirement/exemption apply to New Construction only or to New Construction AND Existing Buildings/Renovations for including energy recovery into the baseline condition?

That is correct if you don't meet the exception you cannot apply it.
It clearly applies to new construction. It applies to renovations if you are replacing the HVAC equipment in the existing space.
