Hello. For achieving EA C3 Enhanced Commissioning, Wwe noted the clause in guidebook "Must not be an employee of the design firm, though he or she may be contracted through them". We are considering if a Cx sub-contractor through MEP design firm is acceptable to be disinterested / independent.
Just wondering, if MEP design firm can employ a sub-contractor, the sub-contractor is not literally "disinterested" while MEP design firm is the party to pay...

Yes, the CxA can be contracted through the design team, including the engineer. However (and I am an engineer) would not recommend it. The person that pays will always have an advantage in any contract. It would not be genuine of me to oppose contractors holding the CxA contract if I would support engineers holding the contract, would it?
An architect holding the subcontract is reasonable, as they have a direct contract with the owner, and are as interested in getting the right services from all their subconsultants.
