Design-Build CxA

In USGBC's "Who can be a Cxa" document (https://www.usgbc.org/resources/who-can-be-cxa), an independent company, not a member of the design team, can be contracted by the architect or engineer to do CxA. On a design-build team, the GC is a part of the design team as well. If the company is independent and not part of the design team, can the GC contract them in a design-build situation as long as the CxA reports everything to the owner?

CxA can't be an employee or a subcontractor of the General Contractor if planning to pursue EAc1. This is introduced, in my opinion, to prevent conflict of interest and maintain the veracity of the Cx process. This should be made a prerequisite.

Mark, Yes, you technically can. LEED Interpretation 10244 was revised in 2014 to allow this specific situation. https://www.usgbc.org/content/li-10244 Note the additional requirements with regards to appointment and reporting.
