I am trying to find out if there is a situation where the CxA on a project can be a part of the same company as the deign team but has not been a part of the design effort? The CxA is strictly chosen for the commisioning effort. Is this allowed in any case. I am aware of a potential conlict of interest here but just want to know if the agent is not a part of the Design team is there a case where this is acceptable. Thanks.

Hi Decorda, there was a recent LEED addenda on this subject: https://www.usgbc.org/leedaddenda/5000127
"If the CxA is an employee of the design or construction firm, upload documentation confirming: that the CxA has no responsibilities related to project design or construction; the CxA is reporting all findings to and communicating directly with the building owner; and the owner has signed off on this arrangement."
I don't know exactly what "documentation" the reviewer would be looking for, whether that means just a narrative or something more formal, but that's the latest.

Hi Emily and Decorda, I would demonstrate compliance with a Declaration Letter signed by the CxA.
