Compliance In Scope

Should I include on the TSLA the credits listed on the CS Appendix 4 with compliace "In Scope" or only those ones in which I selected compliance through "Tenant sales and/or lease agreement"?.
It seems pretty obvious to me that I shall only include the ones with compliance through "Tenant sales and/or lease agreement", but I rather ask for an opinion.

As stated in CS Appendix 4, "if a developer makes technical requirements from the LEED CS rating system part of a binding lease or sales agreement, the project may be able to earn additional points for credits with technical requirements not addressed in the core and shell project design and construction scope." For example if your lease indicates maximum flow rates for tenant installed indoor plumbing fixtures, you can use those rates instead of the baseline. You will provide the binding lease or sales agreement section for each supported prerequisite/credit.
