EAp2 requires adherence to ASHRAE 90.1-2010 Mandatory Requirements at Section 5.4 and elsewhere. For an existing masonry building on a zero lot line, the R-11.4 continuous insulation required cannot be provided due to the condition of the bricks and the moisture management and freeze/thaw risks of insulating to the interior. The municipality will not approve a variance to encroach on the city sidewalk to install continuous insulation to the exterior. How can the building meet the mandatory requirements referenced in EAp2?

Insulation levels are not a mandatory provision.
Also you can insulate such a wall on the inside.See the September 2014 issue of ASHRAE Journal for an example.

We have an existing historic building with thick exterior masonry walls clad on the exterior with stone. We are planning to insulate the inside face of the walls, add storm windows, and replace exterior roof insulation. But we cannot provide continuous insulation and air barrier (such as locations where the upper floors intersect the exterior walls) per ASHRAE 90.1 requirements as the Min. Energy Perf. prereq. requires be followed. It seems there are exceptions provided in ASHRAE that address this (5.1.3), but we are working with an architect that claims they were denied compliance by USGBC for not tearing off the exterior of an existing building to provide continuous insulation as intended.

What the architect is claiming does not sound correct to me. Any more specifics about this claim? As I said above insulation levels are not mandatory provisions.
