alleys and requirement c?

I am wondering if there is a mistake for the item c requirement and its reference (or lack thereof) to exempting alleys? The same prerequisite in LEED ND 2009 exempted alleys and the similar requirement for the LEED ND v.4 walkable streets credit (item j.) exempts alleys. The implication with this omission is that a project cannot have more than 10% alleys (as they rarely have sidewalks on both sides). Given that alleys are an important part of walkable communities this seems like a mistake to me. Can you clarify. Thanks
