A campus project I am working on is located on a site where some agricultural contaminants were discovered in the soil. The developer informed me soils with this contaminant were placed at least 3' below the lowest footing level in the parking garage structure, which is three levels below grade. Would this situation be applicable under Option 3 - Brownfield Remediation? Or would the contaminated soil need to be completely removed from the site and taken elsewhere?

I think the answer likely depends on whether there was a Phase I and Phase II report, the findings of those reports, and documentation of the remediation based on those reports and requirements of the local jurisdiction.
