So we have a difficult v2009 project that strained to achieve simple certification. It came back from prelim construction review with only one comment. The credit in question is worth 2 points and without it we are at 39. There is really no reason for the revised credit not to be accepted, but you never know.
The client could "buy" 2 points with green power if things went wrong, but is there a way to do that after the construction final review? Would that be an appeal or...?

Susan - if you have questions about the way you've addressed the comment, it is possible to email the GBCI reviewers ahead of submitting for final review and get a sense if you've addressed their concern or not. One way that works for me is to add a "Certification Question" via the USGBC contact page. https://www.usgbc.org/contactus
