CS vs NC

The project is a new, ground-up, manufacturing/warehouse/office building, and due to heavy process loads, it does not seem to meet LEED NC EA p2, and the owner will not purchase any new equipment...

Would a high rise condo building (greater than ten floors) be considered LEED for Homes or LEED NC? I think they are thinking LEED NC, but wasn't sure if that could apply.

The project is registered under LEED BD+C: New Construction v2009.

Is there any Addenda that perhaps changed what is required for a project pursuing LEED NCv2009 from 50% to 0...
