SSc3 requires you to address erosion and sedimentation control for future construction activity, so I don't see how you could exclude those portions of your site from your EBOM project boundary. The boundary has to include all land associated with your project building, and the owner should be able to influence the operations on all of that land (i.e. require any contractors to comply with the ESC plan during construction).
